Terms of Service

SpeakTrack is operated by Fabio Marques Company Corp (d/b/a Fabio Marques Company), 4830 W Kennedy Blvd, Suite 600, Tampa, FL 33609, United States. By creating an account you agree to these terms.

1. Who can use it

You must be 18 or older. You are responsible for your account and for keeping your password to yourself. Do not share your login or let someone else use your account.

2. SpeakTrack is in beta, and free

SpeakTrack is free to use during the beta. Being in beta means features will change, some will be rebuilt, and occasionally something will break. We do not promise any level of uptime or availability during this period.

3. The founding-member promise

If you created your account during the beta, you keep the features that are free at the time paid plans are introduced, free, for as long as you hold that account. Those features are: engagement tracking with no limit on how many you log, analytics, the client CRM, travel and expense tracking, the AI assistant, and organizer feedback collection.

We may add new paid features later. Nothing you are already using will be moved behind a paywall. If we ever introduce charges, we will give you at least 30 days’ notice by email first.

4. Your data is yours

You own what you put into SpeakTrack. We claim no ownership of your engagements, client information, notes, expenses, uploaded files or testimonials. You can export your data and you can erase it from Settings at any time.

You grant us only the permission needed to run the service for you — to store your content, display it back to you, generate your reports, and process it through the AI features when you choose to use them.

5. What you are responsible for

SpeakTrack holds information about your clients and event organizers. You confirm that you have a proper basis to hold and enter that information, and that you will handle it lawfully. You agree not to upload anything unlawful, and not to use SpeakTrack to send unsolicited messages to the people whose details you store in it.

You agree not to attempt to access another user’s data, to probe or break the service’s security, or to use it to build a competing product.

6. The AI features

The AI assistant and Travel Tips produce suggestions, not advice. They can be wrong. Check anything you intend to rely on — particularly figures, travel logistics and legal or tax matters — before acting on it. Using those features sends the relevant data to our AI provider, as described in the Privacy Policy.

7. No guaranteed outcomes

SpeakTrack is a tool for running your speaking business. It does not promise you bookings, revenue or results. Your outcomes depend on your own work. The service is provided as is, without warranties of any kind, to the fullest extent the law allows.

8. Limitation of liability

To the fullest extent permitted by law, Fabio Marques Company Corp is not liable for indirect, incidental or consequential damages, or for lost profits, lost bookings or lost data arising from your use of SpeakTrack. Because the service is provided free of charge during the beta, our total liability to you is limited to one hundred US dollars.

Keep your own copies of anything you cannot afford to lose. The export function exists for that reason.

9. Ending it

You can stop using SpeakTrack whenever you like and erase your data from Settings. To close your account entirely, email service@fabiomarques.com.

We may suspend or close an account that breaches these terms, that puts other users or the service at risk, or where we are legally required to. Except where the breach is serious or unlawful, we will give you notice and a reasonable chance to export your data first.

10. Our intellectual property

The SpeakTrack name, logo, interface, and the software itself remain ours. You get a limited, personal, non-transferable right to use the service. You may not copy, modify, resell or redistribute it.

11. Changes to these terms

We will post changes here with an updated date. For changes that materially affect your rights, we will notify account holders by email at least 30 days beforehand. Continuing to use SpeakTrack after that means you accept the change.

12. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and both parties consent to that jurisdiction.
